Hunter Loggins, State Director of the National Federation of Independent Business (NFIB), emphasized the importance of Governor Kemp's tort reform efforts, stating that excessive lawsuits cost Georgia families over $5,500 annually. This statement was made on the NFIB’s website on January 16.
"NFIB applauds Governor Kemp for prioritizing lawsuit abuse," said Loggins. "Georgia's legal system has gotten worse over the years. Small businesses are hit the hardest."
According to the NFIB's website, the proposed reforms aim to create a more business-friendly legal environment by reducing excessive liability, ensuring fairer medical damage awards, protecting businesses from frivolous lawsuits, and regulating third-party litigation funding (TPLF). These measures are expected to lower insurance costs, improve legal predictability, and encourage small businesses to reinvest and create jobs.
The U.S. Chamber of Commerce describes TPLF as a covert, multi-billion-dollar industry in which investors, including foreign entities, bankroll lawsuits for financial gain. This practice raises concerns about escalating legal costs, national security threats, and diminished compensation for plaintiffs. Policymakers are seeking regulation to safeguard the integrity of the U.S. legal system.
In 2024, average full-coverage auto insurance premiums in the U.S. reached $2,543 per year, marking a 26% increase from 2023. Georgia's average cost of $2,610 is slightly above the national average. The rise in premiums is attributed to increased claims frequency and higher repair costs. In 2023, the U.S. recorded 5.5 million auto insurance claims. Bodily injury claims were noted as less frequent but most expensive due to rising medical costs and accident severity.
