TechNet, a national network of tech industry leaders, has filed an amicus brief in the Epic Games v. Apple case currently before the Ninth Circuit Court of Appeals. The brief was submitted alongside the Association of Corporate Counsel and addresses concerns over a district court ruling that allegedly undermines attorney-client privilege for in-house counsel.

The dispute between Apple and Fortnite developer Epic Games is centered on this legal privilege, which TechNet argues is essential for businesses seeking guidance from in-house attorneys. "American businesses, especially small and midsize tech companies, rely on in-house counsel to navigate the fast-changing patchwork of state and federal laws governing emerging technologies," stated Drew Hudson, TechNet’s Vice President and General Counsel.

TechNet's brief emphasizes the role of in-house counsel for startups operating in rapidly evolving sectors like technology and life sciences. These legal advisors are valued for their specialized knowledge crucial to navigating sector-specific regulatory challenges. The organization warns against any legal regime that might discourage companies from fully utilizing their in-house legal resources.

The amicus curiae brief can be accessed through TechNet's channels. Representation for TechNet and the Association of Corporate Counsel is provided by Boyden Gray PLLC.

TechNet’s Innovation Legal Center (ILC) plays a significant role in advocating for pro-innovation laws within both federal and state courts. Led by Drew Hudson, the ILC engages in various activities such as filing amicus briefs and challenging unlawful regulatory actions to support American innovators' interests.
